Presnenskiy District Court of the City of Moscow declined the 1.4 Million Rubles claim filed by Delta Credit Bank, a Russian subsidiary of Societe Generale, against Mrs. Laura Finezilberg, ex-Deputy Chairperson of the bank for «staff poaching» to her new employer, microfinance company MigCredit.
The claim which was filed by Delta Credit as well as the decision rendered by the Russian court has no precedent in the Russian financial market.
«This is the first-in-kind case in the Russian financial market, when the ex-employer and the ex-top manager pass their dispute in relation to the enforceability of the non-solicitation clause in the labour contract to the Court.
