11 April 2013, Yury Tuktarov, Legal Capital Partners partner, will make a report on «Enforcement of Security/Insolvency» at the Moscow LMA Documentation Training.
The training is organized for the members of the association: the leading lawyers, bankers, executives of financial companies, financiers and other professional participants of the international syndicated loan market. In 2013 Legal Capital Partners became the only Russian law firm joined the organization.
Yury will consider the following issues in his report:
consequences of an event of default;
considerations a lender will take into account when an enforcement event arises → enforce or bring borrower to the table;
security available: ability to call on guarantee/indemnity
jurisdiction and governing law provisions: enforceability of any judgments;
role and expectations of stakeholders to any restructuring;
- pre-pack a possibility?
- ability of lenders to recoup monies?
- rights and powers of insolvency practitioners (administrators/liquidators), e.g. right to disclaim an onerous contract: PXF agreements;
local law issues, e.g. is a moratorium available, ranking of creditors, etc.
Yury Tuktarov has more than 15 years' experience in financial transactions. He is an acknowledged as an expert in the fields of innovative legal mechanisms for fund raising on the capital market, structuring financial transactions, and raising investment for infrastructure projects and PPP.
He is one of the principal authors of the Russian draft law On the Development of Project Finance prepared at the request of and in cooperation with the Russian Ministry of Economic Development (2010-2011). Yury has been actively involved in reform of the legislation on pledge under a joint project between the Ministry of Economic Development and the European Bank for Reconstruction and Development, and in developing mortgage lending and securitization in the Russian Federation.
Speaking at the event will be senior lawyers and bankers who are active in the loan market in Russia, including representation from the law firms Allen & Overy, Clifford Chance, and White & Case.
