Our services enabled the parties to continue advancing the project through the implementation stages agreed in the concession agreement. LECAP acted as legal counsel to JSC Chisty Gorod in preparing and supporting amendments to the concession agreement regarding the reconstruction and operation of the waste sorting complex in Ussuriysk, Primorsky Krai (with a capacity of 63,000 tonnes of MSW per year) with respect to changes in the concessionaire’s obligations.

  • The concept for amending the Concession Agreement, providing legal justification for the possibility and reasonableness of the amendments, was presented and agreed.

  • Preparation and approval of amendments to the project documentation to meet the terms of the Concession Agreement.

Project features

  • For the first time, we handled a stressful and conflict-driven situation in the course of implementing a concession project in which a large number of contradictions had accumulated between the parties over several years.  

  • The legislation in the MSW sector changes frequently, and concession agreements quickly come into conflict with the new rules. The uniqueness of the project lay in the need to promptly find ways to resolve the contradictions that arose (the moral “obsolescence” of the concession agreement).
